The City of Chicago resolved its lawsuit against residential construction companies ResiPro, LLC and ResiCap, LP (“Defendants”) for alleged misconduct related to their residential construction activities in the City. The $2.2 million settlement (“the Settlement”) brings to closure the City’s two-year litigation against Defendants for violating the City’s False Claims Ordinance, Construction Code, and Consumer Protection Ordinances.

Homeowners who purchased homes that were renovated by Defendants may be entitled to benefits under the Settlement.  If you are an eligible homeowner of one of the homes listed in the appendix to the Settlement, you will receive a notice and claim form in the mail. To obtain compensation from the Settlement you must return the claim form by May 21, 2024, and schedule an inspection of your home by June 20, 2024.  

Under the Settlement:

• Defendants will pay the City and the Relator who initially filed the case $543,600 to resolve the City’s False Claims Ordinance claim.
• Defendants shall pay $1,656,400 into a Restitution Fund established and administered by the Court-appointed Settlement Administrator. Eligible homeowners who file a claim and have it approved will receive a minimum of $1,000 and maximum of $10,000 that they can use towards remediating any construction issues that Defendants may have caused in their homes.
• Defendants have ceased doing residential construction work in Chicago.
• If Defendants re-enter the Chicago market for the purpose of performing residential construction work in the next five years, they must inform the City in advance, and confirm in writing that they are complying with all applicable laws.
